In these Terms and Conditions “we” and “us” mean Miss Bunting ABN 48 966 759 541 and “you” means you, the customer. The Miss Bunting online email address is info@missbunting.com.au.
These Terms and Conditions together with your order constitute the entire contract between us and you for the supply of products. No other Terms and Conditions will apply. Access and use of the website is subject to these Terms of Use and all applicable laws, statutes, and regulations. The Contract cannot be varied unless we agree to vary it in writing or by email.

Miss Bunting reserves the right to amend these Terms and Conditions at any time. Your continued access to the website and subscription to the newsletter will constitute your acceptance of any changes or revisions to the Terms and Conditions.

Your failure to follow these Terms and Conditions may result in suspension or termination of your access to the website and the newsletter, without notice.

Legal Capacity To Transact

If you are under the age eighteen (18) years you cannot place orders with Miss Bunting. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Should Miss Bunting suffer any damage or other losses as a result of a transaction entered into by a minor, Miss Bunting reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Miss Bunting.

Prices

All prices on our site are displayed in Australian Dollars ($AUD), and will be charged in Australian Dollars.

Miss Bunting reserves the right to change prices without notification for products displayed on our online site at any time. The price payable for the goods shall be the price applicable on the date the goods are ordered. We will endeavour display the most current prices but errors may occur.
Items in your shopping cart will reflect the most recent price displayed on the item’s product detail page. Prices are frequently updated to adjust for different sales, limited pricing, and other discounting. Therefore, prices on the product detail page and in your cart may change after such updates to reflect the current prices. Placing items in your cart does not reserve the current prices shown at that time, and prices are reserved only by placing an order. From time to time, despite our efforts, a small number of the items may be mispriced. Please note that such errors or inaccuracies may be related to product descriptions, pricing and availability. In the event of a pricing error, Miss Bunting will take one of the following options: (i) If an item’s correct price is lower than our stated price, we will charge the lower amount and ship you the item; or (ii) if an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. We apologise for any inconvenience. If you are not satisfied with your purchase due to any errors or inaccuracies, you may return it in accordance with our return procedure. Payment Methods & Processing

Miss Bunting currently accepts Visa & Mastercard only.

Credit Card Fraud

Miss Bunting will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

Security Policy

Miss Bunting uses the eWAY Payment Gateway for its online credit card transactions. eWAY processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. All online credit card transactions performed on this site using the eWAY gateway are secured payments.

• Payments are fully automated with an immediate response.

• Your complete credit card number cannot be viewed by Miss Bunting or any outside party.

• All transactions are performed under 128 Bit SSL Certificate.

• All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data.

• eWAY is an authorised third party processor for all the major Australian banks.

• eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by Miss Bunting

Shipping

Miss Bunting uses Toll Australia DX Express Courier services for Australian deliveries, excluding PO boxes, and offers a flat rate of $9.95 on all Australian orders. Australian orders over $100 will be delivered within Australia free. Most metropolitan destinations within Australia will be delivered within 2 working days, however remote destinations can take longer. Australian PO Box deliveries are shipped using standard Australia Post and can take up to 7 working days, longer to remote locations.

Delivery will be to the delivery address nominated by you between 9am and 5pm Monday to Friday. Please email info@missbunting.com.au if you have concerns about the timing of delivery. We will strive to accommodate your request, bearing in mind time differences and Australia Post procedures and regulations.

If you have an international order, we use Australia Post’s Registered Post service up to 2kg. This will require your signature on receipt of goods. For parcels over 2kg and up to 20kg, we use Australia Posts’s Express Post International – Parcels service. This is their premium affordable parcel service that will also require a signature on delivery and is trackable via auspost.com.au/track to most countries. All our postage costs are determined by the Australia Post International Charging Zones and may change at any time in accordance with any Australia Post changes in delivery charges. Please read the sections regarding International Orders, Customs Declarations, Exchange Rate and International Customs & Duties for further information regarding your international order.

Order Timing

Delivery times will vary depending on stock levels. If there is a delay or your item is out of stock you will be informed. In the case of incomplete delivery, shipping will only be charged on the first delivery. Goods will be dispatched according to their availability. Miss Bunting will not be responsible for any delay of goods due to incomplete order forms or unattainable authorisation by credit card companies or banks.

Delivery

Miss Bunting will dispatch your order Monday – Friday within 48 hours of confirmed purchase authorization, except for orders placed on a weekend or a public holiday, which will not be processed until the next business day. Business days are Monday through Friday, excluding SA Public holidays. Please note that processing times can take up to 3-4 days in busy periods such as Christmas or special sales.

It is your responsibility to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to resend the order to the correct address at our expense.

Please note that if an item has been lost in transit, we will not dispatch a replacement item immediately. Replacement items will be dispatched according to our discretion.

Miss Bunting makes every practical effort to ensure that delivery timeframes given are accurate (currently 2 working days). However the delivery times stated for products on this site assume that the stock is available pending previous orders and that delivery times are not adversely affected by unforeseen events. By placing an order, you agree not to hold Miss Bunting liable for any loss or damage directly or indirectly arising out, of or in connection with any delay or failure to deliver within the estimated time frame.

Here at Miss Bunting, we also like to recycle cardboard boxes in order to help the environment. For this reason, you also may receive recycled newspapers and catalogues as for packing purposes.

International Orders

Shipments made internationally will be sent registered post international, and charged at the rate per kilogram as outlined by Australia Post, shown at point of purchase. http://auspost.com.au/products-and-services/postage-assessment-calculator.html

Most destinations worldwide will be delivered within 5-10 working days.

Remote destinations can take up to 15 working days.

Miss Bunting cannot guarantee these exact shipping windows. Each shipment is different and will vary from country to country.

Note: Due to customs regulations and circumstances beyond our control, there may be some countries or regions that we may be unable to ship to. Should this apply to your country you will be notified by e-mail and the credit card used to purchase will be refunded for the price of the product only.

Customs Declaration

A customs declaration must accompany all international shipments. We are required to state the value of the goods to customs. This will be as per the order value (AUD).

Exchange Rate

All international orders will be paid in Australian Dollars $AUD.

International Taxes & Duties.

Any International Taxes & Duties are payable by yourself (the Customer). Miss Bunting will utilize the best methods to minimize costs of taxes/duties/customs & freight where possible to make your experience in purchasing our product online, as easy as possible.

Return Policy

If for any reason you’re not happy with anything you buy from us simply contact us within 14 days of receipt of the product for a refund, exchange or credit to be used in our store within 6 months (your choice).

Before returning goods or to organise a refund, exchange or credit note, please email info@missbunting.com.au. explaining the reason why you are returning the goods and include the following details: your name, order number, product name/code as well as the reason for exchange.

We will email you with the return address. When approved, forward the goods by registered mail. You will be responsible for shipping and handling charges associated with returns.

Our generous return policy does not apply to items that cannot be returned, such as our made to order items. The returns policy does not apply to sale items. Items purchased at sale prices cannot be exchanged or refunded.

Colours can vary from those shown on your computer; however, if you have purchased the wrong colour or you are not entirely happy with your purchase, Miss Bunting will offer an exchange or credit note to the value of the items purchased, under the following conditions:

Apart from returns for damaged products, all products must be returned to Miss Bunting in a saleable condition. It is the customer’s responsibility to ensure that all returns are packaged so as to prevent damage in transit. Please enclose a copy of your receipt and the return form.

When a product is returned to us, Miss Bunting offers a refund, exchange for goods to the same value or a store credit to the value of the items purchased. We reserve the right to refuse a return on any product that does not meet these requirements. It is suggested that you insure your return package, as Miss Bunting cannot be held responsible for any product lost or damaged in the post.

Goods Damaged or Faulty on Delivery

In the unlikely event that a product is damaged in transit to you, please send us a clear, digital photograph (2MB or less) of the damaged goods by email, quoting your order number and the product item within seven days of receipt of the item to info@missbunting.com.au

For any items that are damaged, found faulty or wrongly described, our customers are entitled to a refund or an exchange. Our policy under these circumstances is if the item is:

(a) Faulty and the fault or defect was not pointed out to you before you purchased it or would not have been apparent to you when you inspected the goods before purchase; or
(b) not ‘of merchantable quality’, meaning that it is not of the quality that you reasonably expected when you purchased it, bearing in mind the way the item was described to you before your purchase and also the price of the item; or
(c) not fit for its purpose, meaning that the item does not do what you reasonably expected it would

Due to the order processing of our website, we cannot accept cancellations. Please make sure you select your products carefully.

While Miss Bunting has endeavoured to ensure the accuracy of the information accessed via the website and distributed via the newsletter, Miss Bunting does not guarantee or give any warranty as to the accuracy, timeliness or completeness of any information or material on the website or in the newsletter. As a subscriber of the newsletter you will be given the opportunity to enter competitions from time to time via the newsletter, as well as the opportunity to take advantage of special offers.

Each competition and special offer is subject to terms and conditions, which will be available to you via the newsletter at the time of entering the competition or viewing the offer.

Any competition that is made available to the public is governed by its own terms and conditions subject to law. The terms and conditions of each competition will be made available to all prospective entrants and should be read in conjunction with this agreement.
